JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 21-09-2017 Heard the counsel for the petitioner and the State. The informant is the mother of the lady who was ensured by the petitioner being an L.I.C. agent. The premium was paid. The daughter of the informant died in 2014 whereafter the claim was made when it revealed that the receipts of payment of installments after the first one, were fake. With these allegations, the complaint was lodged.

Learned counsel for the petitioner submits that the first premium was obtained and deposited by him. The subsequent payments were not deposited by him. In order to pressurize the petitioner, the complaint was lodged. However, for obtaining the privilege of bail, the petitioner shall be ready and willing to pay the amount as directed by this Court either to the

Mr. Dayal, on the other hand, submits that the complicity of the petitioner is evident as against every payment of premium and the commission being drawn and paid to the agent.

However, considering the facts and circumstance of the case, let the petitioner above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each, to the satisfaction of A.C.J.M.-II Chapra, Saran in Rasulpur P.S. Case No. 70 of 2014 on condition that one of the bailors shall be his own/close family member. Along with the bail bonds, the petitioner shall enclose payment by bank instrument in the sum of Rs. 12,000/- either to the complainant or to the husband of Usha Devi. Such payment shall be without prejudice to the right and contention of the petitioner in the case.
