JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-11-2017 Heard learned counsel for the petitioner and State. The petitioner is apprehending his arrest in connection with Complaint Case no. 175 of 2015 for the offence under Sections 420, 468 and 504 of the Indian Penal Code. Counsel for the petitioner submits that the complaint pertains to some consideration for purchase of land way back in 2004 and, for the alleged act and omission in the year 2004, the complaint case was lodged in 2015. He submits that the informant has also filed Title Suit No. 68 of 2015, which is also pending between the parties, in which this petitioner is also one of the defendants. He submits that in the Complaint case two persons were made accused and out of them one Manan Ansari @ Abdun
Patna High Court Cr.Misc. No.53766 of 2017 (2) dt.10-11-2017 2/2 Manan Ansari was granted anticipatory bail by a co-ordinate Bench of this Court in Cr. Misc. No. 46179 of 2016 vide order dated 28.11.2016 and in that view of the matter, the petitioner deserves same treatment.
Considering the aforesaid facts and the fact that the petitioner has no criminal antecedent, as per the statement made on oath in para 3 of this petition, the petitioner, named above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Complaint Case no. 175 of 2015 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
