JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State.

Petitioner is husband of the deceased, who died due to burn injuries within seven years of her marriage. There is allegation that she was subjected to cruelty and harassment on account of non fulfillment of dowry demand and lastly, she was set on fire.

The contention on behalf of petitioner is that the deceased was caught in fire accidentally and when the aforesaid fact came to the notice of the informant, the informant has filed compromise petition before the court.

Regard being had to the facts and circumstances of the

Patna High Court Cr.Misc. No.50322 of 2014 (4) dt.26-03-2015 2/2 case as well as submission of the parties, I am not inclined to grant privilege of bail to the petitioner, accordingly, his prayer for bail in connection with Kateya P.S.Case No. 148 of 2014, pending in the court of Judicial Magistrate, 1st class, Gopalganj stands rejected.
