JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-07-2019 The short prayer of the petitioner is to direct the respondent authorities to remove the encroachment from the land meant for use as a road, pond and nala, over which encroachment has been made by unauthorized people. Having regard to the facts and circumstances of the case, this Court deems it fit and appropriate to dispose of this case with liberty to the petitioner to approach the Circle Officer, Dhaoraiya, Dist-Banka by filing a petition under the provisions of the Bihar Land Encroachment Act, 1956, which shall be examined by the said Circle officer and if required, necessary encroachment proceedings shall be initiated under the

Patna High Court CWJC No.14470 of 2019(2) dt.23-07-2019 2/2 provisions of the Bihar Land Encroachment Act, 1956 and the same shall be taken to its logical end.

The present writ petition stands disposed off with the aforesaid directions.
