The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a) and 32 of the Bihar Prohibition and Excise Act, 2016. It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 30.6.2021 (Annexure 1) passed in Cr. Misc. no. 5363 of 2021 giving liberty to the petitioner to renew his prayer for bail after completing one year in custody. The petitioner is in custody since 14.9.2020.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the observation given in the aforesaid order dated 30.6.2021 together with the petitioner having

Patna High Court CR. MISC. No.56950 of 2021(2) dt.29-09-2021 2/2 remained in custody for over one year, the Court directs the petitioner to be enlarged on bail in connection with Industrial Area P.S. Case no. 100 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District and Sessions Judge, Excise, Bhagalpur/Incharge Successor Court.
