JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 13-09-2018 Heard learned counsel for the petitioner and learned counsel for the respondents.

The present writ petition has been filed for the following reliefs - "(A) For, issuance of writ of certiorari for quashing the letter no. 512 dated 21/06/2013 issued from the office of the respondent No.- 4 Block Development Officer, Navanagar, Buxar, whereby and where under the respondent B.D.O. has asked the petitioner to show cause within a period of two weeks as to why the report should not be made to the Certificate Officer to proceed against you further in Certificate Case No. 51/2011-2012( Annexure-3).

(B) For, a direction to the respondent B.D.O. and to the certificate officer not to proceed further in certificate case no. 51/2011-2012, unless the account for the

Patna High Court CWJC No.13271 of 2013 dt.13-09-2018 2/2 lifted grains under S.G.R.Y. in the year 2002-06 is finalized after giving the petitioner opportunity to account the same in the presence of Block Development Officer.

(C) For any other relief/reliefs to which the petitioner maybe found entitled in the facts and circumstances of the case."

Learned counsel for the petitioner informs that the Enquiry Commission of Hon'ble Mr. Justice Udai Sinha (Retired) has now submitted its report and any further action in relation to recovery of the value of undistributed rice under the SGRY Scheme would abide by the decision of the State Government to be taken on the basis of such report.

4. In the above view of the matter, learned counsel for the petitioner seeks permission to withdraw the present writ petition with liberty to approach this Court afresh if and when the occasion arises in future.
