Learned counsel for the petitioner submits that in a land dispute between the informant and Ganesh Singh and others, it is alleged that the petitioner was also present at the seen of the occurrence but nothing overt act is alleged against this petitioner. He submitted that in Cr. Misc. No. 47590 of 2017 vide order dated 11.10.2017, five persons having similar allegations of assault have been granted anticipatory bail by this Court. The case of the petitioner is on better footing and as such the petitioner deserves anticipatory bail.
Considering the fact that the similarly circumstanced other co-accused have been granted anticipatory bail in Cr. Misc. No. 47590 of 2017, let the petitioner, above named, in the event of
Patna High Court Cr.Misc. No.47374 of 2017(2) dt.17-10-2017 2/2 arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in connection with Alauli P. S. Case No. 151 of 2017, subject to the conditions as laid down under Section 438(2) Cr. P. C.
