1. Heard Mr. Abhishek Anand, learned counsel for the petitioner and Mr. Sanjay Kumar Tiwary, learned APP for the State.
2. The petitioner seeks regular bail in connection with N.D.P.S. Case No. 132 of 2025, arising out of Sahayak Khajanchi P. S. Case No. 72 of 2025, dated 02.03.2025 registered for the offences punishable under Sections 313, 317(4) and 3(5) of the B.N.S., 2023 and Sections 8(c), 21(b) and 25 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
3. The main submissions advanced by the petitioner's counsel are that the instant matter relates to the recovery of narcotic material suspected to be 'smack' from the alleged vehicle from the possession of two co-accused persons who

No.47363 of 2025(2) dt.04-08-2025 2/3 were travelling in the alleged vehicle, though, as per the allegation, the petitioner was also found travelling in that vehicle but he was bonafide passenger and had taken lift in the said vehicle however, from his person or possession nothing illegal material or narcotic contraband was recovered, so, he has been made accused mainly on account of being present in the alleged vehicle. It is further submitted that the instant matter relates to the recovery of total 23 of grams narcotic material suspected to be 'smack' which comes under the purview of intermediate quantity and one co-accused namely, Raju Mukhiya carrying more serious allegation than this petitioner has been granted bail by the co-ordinate bench of this court vide order dated 22.07.2025 passed in Cr. Misc. No. 42941 of 2025. It is lastly submitted that the petitioner has been languishing in jail since 02.03.2025 and he has never involved in relation to any recovery of contraband.
4. Learned APP appearing for the State has opposed the bail prayer of the petitioner .
5. Considering the aforesaid submissions advanced by the petitioner's counsel, this court is inclined to release him on bail. Accordingly, let the petitioner named-above, be enlarged on bail in connection with N.D.P.S. Case No. 132 of 2025,
Patna High Court CR. MISC. No.47363 of 2025(2) dt.04-08-2025 3/3 arising out of Sahayak Khajanchi P. S. Case No. 72 of 2025, on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
