JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Taraiya P.S. Case No. 143 of 2019 registered for the offences punishable under Sections 420/34 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act. Allegation against the petitioner is that marriage of daughter of the informant was fixed with the petitioner and ring ceremony was also held and date was also fixed and Rs.8 lac was transferred to the account of Ramnath Singh, father of the petitioner but later on they demanded Rs.25 lac and Maruti car. Further case is that when the informant went to inquire about the same the accused persons abused and threatened him. No.43851 of 2019(2) dt.17-07-2019 2/3 misunderstanding between the parties and amount has already been returned to the informant and considering the same, father of petitioner has already been granted anticipatory bail vide order dated 8.7.2019 passed in Cr.Misc.No. 41767 of 2019 by a co-ordinate Bench of this Court.
Heard learned APP and learned counsel for the informant, who has opposed the prayer for anticipatory bail on the ground that apart from Rs.8 lac, Rs.7 lac has also been given at the time of Sagai and that amount has not been returned and they have also made threatening to withdraw the case also. In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IX, Saran at Chapra, in connection with Taraiya P.S. Case No. 143 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner has to cooperate in the investigation and appear before the police as and
