JUSTICE ARUN KUMAR ORAL ORDER 11-08-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Sections 406 and 420 of the Indian Penal Code.

Allegation in brief is that the informant entered into an agreement for purchasing land from one of the co-accused Jagarnath Mistri owner of the land through the broker Gudu Gop. The specific allegation against the petitioner is that while she handed over the money in cash of Rs.61,00,000/- to the broker this petitioner was also along with him and on the day of execution of sale deed they had taken Rs.2,00,000/- in cash for purchasing stamp as well as a copy of the agreement and thereafter never returned back.

Patna High Court Cr.Misc. No.37624 of 2017 (2) dt.11-08-2017 2/2 It is submitted that the petitioner has got no role in this transaction neither he is broker nor the land owner and the broker has been granted anticipatory bail by a Co-ordinate Bench of this Court by Cr. Misc. No.19082 of 2017.

Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Dhiraj Kumar be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Danapur in connection with Danapuir P.S. Case No.168 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
