The petitioner seeks regular bail in a case under sections 394, 376/511 of the Indian Penal Code. The petitioner is not named in the first information report. The informant alleged that three persons entered into his house and the accused persons tried to commit rape with his wife. On alarm, one accused, namely, Kamakhya Singh alias Jhotil was arrested. Kamakhya Singh disclosed the name of other accused person, namely, Jiut Dhangar. Name of the petitioner figured in the third statement of the informant. Petitioner had no knowledge about his being made accused in the present case but the petitioner was declared absconder. The

Patna High Court Cr.Misc. No.50020 of 2014 (3) dt.14-05-2015 petitioner was arrested on 10.06.2013 and since then he is in jail. As such the petitioner has already remained in jail for one year and ten months.

Considering the facts aforesaid, the above named petitioner Sattan Bhar is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bagaha (West Champaran) in connection with Gobardhana P.S. Case no. 6 of 1985.
