JUSTICE MOHIT KUMAR SHAH ORAL ORDER 27-03-2023 The present writ petition has been filed seeking the following relief:- "1. That in the instant writ petition, the petitioner prays for issuance of appropriate writ or writs, order or orders, direction or directions commanding the concern respondents to immediately take proper steps to stop the construction of public / passenger shed in the Government Land situated at MauzaPathra, Labokhar, Thana No. 120, Jamabandi No. 215, Khata No. 347, Khesra No. 2860, CircleBarahat, area 54 1⁄2 decimal, beside the Barahat Main Road because aforesaid construction will block the frontage of the Housing of the petitioner

Patna High Court CWJC No.5262 of 2015(2) dt.27-03-2023 2/2 and restrain him for his peaceful easement.

And Petitioner further prays for issuance of appropriate writ or writs, order or orders, direction or directions commanding the concern Respondents to shift the aforesaid construction to the place where actually buses are stopped i.e. 100 meter distance from the present construction side and stay the further construction from the aforesaid area."

At the outset, liberty is sought for on behalf of the petitioner to approach the District Magistrate, Banka for redressal of the aforesaid grievances of the petitioner. Liberty, so sought, is granted.
