JUSTICE ARVIND SRIVASTAVA ORAL ORDER 12-09-2017 Heard learned counsels for the petitioners and the State. Petitioners apprehend arrest in connection with Babubarhi P.S. Case No. 189 of 2016 registered for the offence punishable under sections 143, 341, 323, 386, 504, 34 of the Indian Penal Code.

Learned counsel appearing for the petitioners submits that petitioners and the informant are agnates. Dispute is with regard to Chanda collected for construction of Temple. Petitioner no. 1 was Chairman of the Samiti in the year 2010. no aggrieved person has come forward to state regarding demand of Rangdari by petitioners. There is case and counter case between the parties.

No.36225 of 2017(4) dt.12-09-2017 2/2 Considering the facts and circumstances of the case and the submissions of advanced on behalf of the parties, let the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate II, Madhubani in connection with Babubarhi P.S. Case No. 189 of 2016 subject to the conditions laid down under section 438(2) Cr.P.C.
