The petitioner seeks bail in Charpokhari P.S. Case No. 51 of 2014, registered for the offences punishable under Section 379 of the Indian Penal Code.

Allegation against the petitioner and other accused persons is that they committed theft of tractor and trailor. Name of the petitioner surfaced in the confessional statement of co-accused and stolen tractor is said to have been recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that the tractor was recovered by the side of the road and not from the conscious possession of the petitioner. Other accused persons namely Ashok Yadav, Deepu Sharma and Buchan Singh @

Patna High Court Cr.Misc. No.49160 of 2014 (3) dt.19-03-2015 2/2 Bhagwan Singh have already been enlarged on bail vide orders passed in Cr. Misc. No. 38031 of 2014, Cr. Misc. No. 4667 of 2015 and Cr. Misc. No. 50197 of 2014.

Considering the facts aforesaid and the fact that the petitioner has already remained in jail for about five months, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Charpokhari P.S. Case No. 51 of 2014.
