This application, for grant of anticipatory bail, arises out of Chousa Police Station Case No. 13 of 2016, disclosing offences under Sections 304(B), 201, 120(B), 34 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the petitioner happens to be first wife of the husband of the informant's daughter and she being Soutan of the informant has falsely been implicated in this case merely on the basis of suspicion. Hence, the petitioner deserves the privilege of anticipatory bail.

Patna High Court Cr.Misc. No.36736 of 2017 (4) dt.10-10-2017 Learned A.P.P. for the State has vehemently opposed the prayer for bail and submitted that the petitioner is named in the F.I.R. and there is allegation of assault and with the help of other accused persons, the petitioner has buried the dead body of the informant.

Considering the facts and circumstances of the case, this Court is not inclined to grant the privilege of anticipatory bail. Accordingly, the prayer for anticipatory bail of this petitioner is rejected.
