The petitioner is apprehending his arrest in a case registered under Sections 154, 160(2) of Railway Act. Allegation against the petitioner is that on the alleged date of occurrence he dashed the vehicle with the gate barrier boom and subsequently broken the gate barrier boom. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. Due to technical problem the vehicle of the petitioner dashed with the railway gate. The petitioner had no intention to damage the

On behalf of the State, it is submitted that the petitioner is named in the prosecution report.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Bhagalpur in connection with R.P.F./Bhagalpur case No.477 of 2017, Checking case No.624 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
