2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 147, 148, 149, 448, 354B, 307, 379, 504 and 506 of the Indian Penal Code, in connection with Barhara P.S. Case No. 95 of 2024.

3. As per prosecution case, the allegation against the petitioner along with others is of brutally assaulted the brotherin-law of the informant due to which he sustained injury. It is further alleged that other co-accused took away a gold chain worth of Rs. 85,000/- from the neck of informant's brother-inlaw.

4. The learned counsel for the petitioner has submitted that he has been falsely implicated in this case and has committed no offence. He submitted that the alleged occurrence took place on account of land dispute between the parties. He submitted that there is a case and counter case between the parties and members of both parties have sustained injuries. Moreover, petitioner is a person of clean antecedent and he is in custody since 09.04.2024.

5. On the other hand, learned counsel for the informant has vehemently opposed the prayer of bail by submitting that there is specific allegation against the petitioner that he inflicted iron rod blow to the informant's brother-in-law, due to which he sustained grievous injury.

Considering the above facts and circumstances of the case as well as petitioner has clean antecedent, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Barhara P.S. Case No. 95 of 2024, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.

7. The petitioner shall furnish his bail bonds after completion of six months in custody.
