The petitioner is apprehending his arrest in connection with Baghaila P.S. Case No. 56/2018, registered for the offences punishable under Sections 30(a), 38(1)(2) and 47 of the Bihar Excise and Prohibition Act.
From a locked Garage, liquour was allegedly recovered after breaking open the lock and allegation is that the petitioner fled away from there.
Submission is that there is no substantial material against the petitioner.
Since petitioner has got identical criminal antecedent vide Baghaila P.S. Case No. 44/2017 registered for the offence under Section 30(a) of the Bihar Excise and Prohibition Act, I
Patna High Court Cr.Misc. No.63297 of 2018(3) dt.15-01-2019 2/2 am not inclined to enlarge the petitioner above-named on anticipatory bail. Prayer is rejected.
However, in the event of surrender, prayer for regular bail shall be considered without being prejudiced by this order. (Birendra Kumar, J) vinita/- U T
