The petitioner seeks bail in Shikarpur P.S. Case No. 379 of 2020, registered for the offence under Section 307 & other allied sections of the Indian Penal Code. As per the F.I.R., this petitioner is alleged to have assaulted Kundan Kumar on his head by farsa.

It is submitted on behalf of petitioner that as per injury report, the doctor has found one injury on the head of Kundan Kumar caused by hard & blunt substance. Allegation of blow by farsa is not supported by injury report. Petitioner has got clean antecedent and he is in custody since 23.02.2021. Investigation is complete.

Learned A.P.P. for the State has opposed the bail petition and submitted that injury caused by this petitioner has been found to be grievous in nature.

Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran in connection with Shikarpur P.S. Case No. 379 of 2020.
