JUSTICE SANJAY KUMAR ORAL ORDER 19-08-2017 Heard learned counsel for the petitioners and leaned Additional Public Prosecutor of the State.
The petitioners are apprehending their arrest in connection with Kako P.S.Case No. 199 of 2016 registered for offences punishable under Sections 147, 148, 341, 323, 307, 379, 427 and 504 of the Indian Penal Code.
Allegation as per written report is that these petitioners along with 20-25 unknown persons brutally assaulted the brothers of the informant and his nephew. There is also a land dispute between the parties and a Title Suit No. 75 of 2003 is pending in
Patna High Court Cr.Misc. No.39396 of 2017 (2) dt.19-08-2017 2/2 the Court of Munsif, Jehanabad. There is also a counter case from the side of the petitioners' as Kako P.S.Case No. 200 of 2017 .The injury report, which is annexed with the petition shows that all the brothers of the informant sustained solitary injury on their person, caused by hard and blunt substance, which are simple in nature.
Learned Additional Public Prosecutor opposes the prayer for bail.
Having regard the facts and circumstances of the case, the prayer of Anticipatory bail of petitioners is allowed and the petitioners in the event of their arrest or surrender before the Court below within a period of six weeks, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each in connection with Kako P.S.Case No. 199 of 2016 to the satisfaction of Shri R.k. Rajak, learned Additional Chief Judicial Magistrate, Jehanabad, subject to the condition laid down under Section 438 (2) of the Criminal Procedure Code. (Sanjay Kumar, J) Sudha/- U T
