The petitioner apprehends his arrest in Mahila P.S. Case No.18 of 2021 registered under Sections 376 and 420 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. It is further submitted that the victim is a major girl and the F.I.R. has been lodged after much delay of alleged occurrence. He also submits that the victim in her statement under Section 164 of the Cr.P.C. has stated that the case has been lodged after denial of marriage by the petitioner vide Annexure 2. The petitioner has got no criminal antecedent.
Having considered the above facts and circumstances
Patna High Court CR. MISC. No.56785 of 2021(2) dt.13-05-2022 2/2 of the case, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing personal bond to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Mahila P.S.
