The petitioner seeks bail in a criminal prosecution registered under Sections 376, 511, 34 of the Indian Penal Code as also under Section 6 of The Protection of Children from Sexual Offences Act, 2012.
Taking into consideration the fact that the petitioner is the sole accused named in the F.I.R. Vide Annexure-1 and there is specific allegation for commission of crime in question against him, this Court is not inclined to accede to the prayer made on behalf of the petitioner for grant of bail in connection with Majhauliya P.S. Case No. 306 of 2014, pending in the court of learned 1st Additional District & Sessions Judge cum Special Judge, Bettiah, West Champaran. Accordingly, the prayer for bail is rejected.
However, learned 1st Additional District & Sessions Judge cum Special Judge, Bettiah, West Champaran is directed to take up the trial of the petitioner on priority basis and if the trial of the petitioner is not concluded within a period of one year from
