The petitioner seeks regular bail in a case registered for offences punishable under Section 376 of the Indian Penal Code. Submission made on behalf of the petitioner is that even if allegation made in the F.I.R., is treated to be true, no offence under Section 376 can be said to be made out as the physical relationship between the petitioner and the informant took place apparently with the consent of the victim.
