JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 03-03-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. Petitioners are in custody since 9.9.2014 in a case registered for the offence punishable under Sections 399 and 402 of the Indian Penal Code and 25(1-b) a, 26 and 35 of the Arms Act.

Allegedly they were caught by the police and from their possession mobile phone and bunch of keys were recovered from petitioner no.2 whereas from possession of the petitioners loaded country made pistol were recovered.

Keeping in view the nature of allegations and the period of custody as well as averment made in paragraph 3 that the

No.49805 of 2014 (2) dt.03-03-2015 petitioners have no criminal antecedent, let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in Siwan Town P.S. case No. 367 of 2014.

The Court excepts good conduct from these petitioners by virtue of the present order and the prosecution shall be at liberty to approach this Court for cancellation of bail granted by the present order if they are found indulged in such activities in future.
