The Apex Court has already decided the similar issue in the case of Mukesh & anr. Vs. The State of Bihar & Ors: (2017) 5 SCC 383.
Accordingly, the writ petition is disposed of with a direction to the respondent-District Programme Officer, Katihar to examine the case of the petitioner strictly within the parameters of the principles laid down by the Apex Court in that case and take appropriate decision on the claim of the petitioner within a period of 4 months from the date of receipt/production of a copy of this order.
