JUSTICE MOHIT KUMAR SHAH ORAL ORDER 24-08-2022 The present writ petition has been filed for directing the respondents to restrain themselves from evicting the petitioner from the land bearing Khata No. 258, Khesra No. 1277, Thana No. 69 situated at Mauja-Lashgani, DistrictLakhisarai. The learned counsel for the petitioner has submitted that announcement has been made on loudspeaker by the Railway administration to vacate the land in question, failing which the structure present on the same, shall be demolished,

This Court finds that such similar type of writ petitions have already been disposed off by this Court with liberty to the petitioner to file appropriate show cause reply, whereupon the Estate Officer, Eastern Railway, Malda Town, West Bengal, has been directed to dispose off the same, in accordance with law and till then status quo has been directed to be maintained.

Having regard to the facts and circumstances of the case, the respondents are granted liberty to issue notice to the petitioner, seek his show cause reply and then pass appropriate orders and till then it is directed that status quo existing as on today, shall be maintained.

The writ petition stands disposed off on the aforesaid terms.
