The petitioner seeks bail in Bahera P.S. Case No. 37 of 2014, corresponding to Sessions Trial No. 294 of 2014, registered for the offences punishable under Section 366A and other Sections of the Indian Penal Code.
The mother of the victim alleged that the petitioner has kidnapped her minor daughter. During the course of investigation the victim made her statement under Section 164 of the Cr.P.C. and disclosed that the petitioner and others kidnapped her and took her to Delhi and the petitioner forcibly committed rape with the victim. The victim is minor.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same
Patna High Court Cr.Misc. No.49837 of 2014 (3) dt.09-04-2015 2/2 is rejected.
The trial court is directed to expedite the trial and conclude the same within one year from the date of receipt/production of a copy of this order.
