JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner and the State. The petitioner is an accused in a case under sections 328 and 379 of the Penal Code.
Learned counsel for the petitioner submits the petitioner is not named in the F.I.R. and there is no recovery from his place. The name of the petitioner figured on the confessional statement of co-accused. He further submits that there is no Test Identification Parade and he is in custody since 17.5.2014. Considering the facts and circumstances of the case, the petitioner Surendra Sah is directed to be released on bail in connection with Narkatiaganj P.S. Case No.9 of 2014 on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, West Champaran, Bettiah, subject to the condition that he will not physically absent himself for two consecutive dates at a stretch till charge is framed.
