JUSTICE RAKESH KUMAR ORAL ORDER 17-10-2017 Heard Sri Brij Kishor Mishra, learned counsel for the petitioners and learned Additional Public Prosecutor. Seven petitioners, apprehending their arrest in Sahodra P.S. Case No. 36 of 2017 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 have prayed for grant of bail in the event of their arrest or surrender.

It was submitted by learned counsel for the petitioners that nothing was recovered from conscious possession of either of the petitioners and petitioners were named in the F.I.R. as accused on the statement of Chaukidar as if petitioners had fled

Patna High Court Cr.Misc. No.48915 of 2017(2) dt.17-10-2017 2/2 away after noticing Police. It has also been indicated by drawing attention of this court to the statement made in paragraph no. 3 of this petition that petitioners are having clean antecedent.

Considering the facts and circumstances as well as clean antecedent of the petitioners, in the event of their arrest or surrender within a period of six weeks from today, let the aforesaid seven petitioners Ravi Manjhi, Jitendra Manjhi, Dhanesh Mahto, Ramnath Mahto, Antilal Mahto, Tulsi Mahto, Dinesh Mahto be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, District - West Champaran / concerned court in connection with Sahodra P.S. Case No. 36 of 2017 subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure , 1973 .
