2. The present writ petition has been filed for directing the respondents to issue appointment letter to the petitioner on the post of Prerak in Gram Panchayat, Narayanpur, Block Ratani, Faridpur, District- Jehanabad.

3. Learned counsel for the petitioner submits that the

Patna High Court CWJC No.2870 of 2012(9) dt.14-12-2023 2/2 petitioner was competent according with rule for the post in question but the authority has appointed respondent no. 9 to the said post in question and so he has challenged the appointment of respondent no. 9.

4. Learned counsel appearing on behalf of the State has filed counter affidavit today which is kept on the record in which he has clearly stated that the post in question has been made abolished by the Government of India w.e.f 31.03.2018 and the same has been communicated to the authority concerned vide letter dated 17.09.2018.

5. Learned counsel for the petitioner outrightly submits that in view of the letter annexed with the counter affidavit, the present writ petition has become infructuous. Hence, he seeks permission to withdraw this writ petition.

6. Permission is accorded.

7. Accordingly, this writ petition stands dismissed as withdrawn.
