JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-06-2015 The petitioner being husband of the victim has renewed prayer for bail in connection in a case registered for the offences punishable under section 304B/34 of the Indian Penal Code.
The petitioner is in custody since 25.02.2013 with accusation of killing the daughter of the informant for nonfulfillment of dowry demand. The report of learned Adhoc Additional Sessions Judge, VIII, Purnea dated 6th May 2013 reflects that out of nine chargesheeted witnesses seven have been examined. Similar is the report of the Superintendent of Police, Purnea dated 16.04.2015 and now only two witnesses are left to be examined, who are, informant Bholu Sah and Dr. Rajesh Bharti. The report also reflects that the trial is likely to be concluded within a period of

It is submitted by learned counsel for the petitioner that informant is dead and witnesses have not supported the accusation.
Considering the present stage of the trial, this court is not inclined to consider the present prayer of the petitioner. Accordingly, the application is disposed of.
It is expected from the Superintendent of Police, Purnea to produce the left over witnesses forthwith. It is expected from the trial court to conclude the trial in Sessions Trial No.524 of 2013 arising out of K. Hat P.S. Case No.80 of 2013, within the time frame.
Let this order be communicated to the Superintendent of Police, Purnea.
