The petitioner apprehends his arrest in connection with Rajnagar P. S. Case No. 28 of 2013 (GR No. 307/2013) instituted under Sections 149 and 420 of the Indian Penal Code. The allegation, in brief, is that one Anil Kapoor Paswan was appearing in Intermediate examination in place of this petitioner and caught red handed while giving examination at the examination centre.

It is submitted that this petitioner was appearing himself as a candidate whereas learned counsel for the State submits that co-accused Anil Kapoor Paswan was apprehended at the spot possessing with the admit card of this petitioner in place of him.

Patna High Court Cr.Misc. No.39142 of 2017 (2) dt.21-08-2017 2/2 Having considered the said fact, it is not a fit case for granting anticipatory bail. Accordingly, the prayer for anticipatory bail is rejected.
