Petitioner seeks bail in Hasanpur P.S. Case No.39 of 2019 instituted for the offence under Section(s) 30(a) of Bihar Prohibition and Excise Act, 2016.
It is alleged that total 381.06 litres foreign liquor has been recovered from husk-house of the petitioner. Counsel for the petitioner submits that Petitioner has been arrested merely on suspicion. There is no recovery of any liquor from conscious possession of the petitioner. Seizure list has been prepared by the police, but there is no signature either of the petitioner or any of his family members on the seizure list.
Petitioner is in custody since 03.06.2019 having clean

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II cum Special Judge, Excise Act, Samastipur, in connection with Hasanpur P.S. Case No.39 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
