====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 06-12-2021 Heard learned counsel for the parties including the learned counsel for the informant.

The petitioner apprehends his arrest in connection with Jamhore P.S. Case No. 23 of 2020 registered for the offence under Sections 147, 148, 149, 341, 323, 307, 302 of the Indian Penal Code and under Section 27 of the Arms Act.

The petitioner is said to be member of the mob, which assaulted the prosecution party and altogether five persons were injured including the deceased.

Considering the fact that the petitioner is a member of the mob and death has been caused in the prosecution side, this is not a fit case for grant of anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail is rejected. In case the petitioner surrenders and prays for regular bail before the Court below within a period of four weeks from today, the court below will consider the petition for regular bail of the petitioners without

Patna High Court CR. MISC. No.8107 of 2021(2) dt.06-12-2021 2/2 being prejudice by the fact that anticipatory bail petition has been rejected by this Court.
