2. The present writ petition has been preferred for the following relief(s):

(i) For issuance of a writ in the nature of mandamus commanding the respondent no.3 to mutate the name of Basant Mahto after registering a Mutation Case with regards to the following land:

Khata No.-Plot No.-Area-Boundary 199 -80 -54 Dec.-N-Sattar Mian -S-Mandal Co-operative -E-Hari Narayan Singh/ Pairu Mahto -W-Ahar Situated at Mauza-Saguna, Mohalla-Saguna Isopur, Block- Fulwari, Survey Thana and RegistryDanapur which falls under Thana No.23, Tauzi No.5282 in the District of Patna.

3. Learned State Counsel has taken this Court to paragraph 7 of the counter affidavit which read as follows:

7. That it is further submitted in this context that on search in the office of CO Danapur no application for mutation filled by and claimed by the petitioner, has been found. However if the petitioner will file application for mutating his name on basis of document the same will be considered and disposed of as per law.

4. The copy was served to the learned counsel for the petitioner in the year 2016 and there is no rebuttal.

5. In that background, nothing remains, if there is no application before the Competent Authority, the matter cannot move further.

6. In that background, granting liberty to the petitioner, the writ petition is disposed of. (Rajiv Roy, J) Vijay Singh/- U
