Earlier prayer for bail of the petitioner was rejected by a coordinate bench of this court vide order dated 07-04-2014 passed in Cr. Misc. No. 3893 of 2014 directing the trial court to expedite the trial of the petitioner but the trial court has reported that out of 11 proposed prosecution witnesses, uptill now, only three prosecution witnesses could be examined. The petitioner is in jail custody since 18-10-2013 in a case which has been registered for the offence under Sections419, 420, 467, 468, 471 and 120(B) of the Indian Penal Code read with Section-8, 13(2), 13(1)(D) of the Prevention of Corruption Act.
Patna High Court Cr.Misc. No.51116 of 2014 (3) dt.02-04-2015 2/2 However, it is an admitted position that when the occurrence took place, the petitioner was in jail custody and it can only be said that the petitioner was beneficiary of the forged document.
Taking into consideration the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Special Case No. 25 of 2009 arising out of Vigilance P.S. Case No. 32 of 2009 to the satisfaction of Special Judge, (Vigilance-Ist) Patna. (Hemant Kumar Srivastava, J) A.K.V./- U T
