JUSTICE ARVIND SRIVASTAVA ORAL ORDER 14-09-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Mahkar P.S. Case No. 77 of 2016 registered for the offence punishable under sections 304B/201/34 of the Indian Penal Code. Learned counsels appearing for the petitioner submits that petitioner has falsely been implicated in this case. Petitioner was leading a very peaceful conjugal life with his wife and children. The deceased has committed suicide due to depression. None of the witnesses has said about the involvement of this petitioner in the alleged crime.
Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that petitioner being the husband was very much responsible to keep his wife with full honour and dignity, but he failed to do so. Witnesses have also stated
Patna High Court Cr.Misc. No.34653 of 2017(5) dt.14-09-2017 2/2 about the scuffle between the deceased and the members of her in-laws family.
Considering the nature of allegations levelled and the submissions advanced on behalf of the parties, this court does not find it to be a fit case for grant of anticipatory bail. It is, accordingly, rejected.
