The petitioner seeks bail in a case instituted for the offences under Sections 420, 409, 379/34 of the Indian Penal Code.

The prosecution case in short is that the accused persons misappropriated and defalcated huge sum of money of the informant by cheating her.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.5.2019. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is alleged to be Manager of the informant. From the entire F.I.R., it does not appear that any

Patna High Court CR. MISC. No.45838 of 2019(2) dt.24-07-2019 2/2 wrongful gain has been made on the part of the petitioner. There was a family dispute between the informant and her devar which led to the institution of this case. The matter relates to civil dispute.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. XI, Bhojpur in connection with Jagdishpur P.S. Case No. 289/2018.
