The petitioner seeks bail in connection with Kalyanpur P.S. Case No.261 of 2020, instituted for the offences under Section 30(a), 41(i) (ii) of the Bihar Prohibition and Excise Act, 2016.

The learned senior counsel for the petitioner submits that the petitioner is in custody since 02.03.2021 and chargesheet has been submitted in this case and allegation is of recovery of 75.60 litres of foreign liquor from the hut of one Bindeshwar Mahto.

The learned senior counsel for the petitioner submits that the petitioner came to be implicated based on his antecedent

Patna High Court CR. MISC. No.57056 of 2021(2) dt.07-01-2022 2/2 as mentioned in para -3 of the bail application. Learned A.P.P. opposes the bail application.

Considering the fact that petitioner is in custody since 02.03.2021 and charge-sheet has been submitted, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.5,000/- (Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-II-cum-Special Judge, Excise, Samastipur, in connection with Kalyanpur P.S. Case No.261 of 2020.

The application stands allowed.
