The petitioner is apprehending his arrest in connection with Forbesganj P.S. Case No. 58 of 2017 registered for the offences punishable under Sections 25(1-b)a/26 of the Arms Act. As per First Information Report, Forbesganj P.S. Case No. 608 of 2014 registered under Section 25(1-b)a/26 of the Arms Act wherein the informant was Birbal Mandal, was found false against Bhupesh Mandal and as per the supervision of S.D.P.O., Forbesganj, First Information Report has been lodged against the petitioner also including that of Birbal Mandal as the petitioner is Bhagin Damad of Birbal Mandal.
Submission is of false implication and that the First Information Report is lodged against the provision of law. The petitioner has got no concern with the informant of Forbesganj
Patna High Court Cr.Misc. No.35402 of 2017 (2) dt.11-08-2017 2/2 P.S. Case No. 608 of 2014 and only due to relative, the petitioner has been implicated. No arm and ammunition has been recovered from the possession of the petitioner and, as such, he deserves sympathetic consideration.
The learned A.P.P. opposes the prayer of pre-arrest bail.
In the facts and circumstances as stated above, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of the copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 58 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Jitendra Mohan Sharma, J) Vats/- U T
