The petitioner is apprehending her arrest in connection with Basantpur P.S. Case No. 142/2018, registered for the offences punishable under Sections 366(A), 376, 211, 506, 120(B) and 34 of the Indian Penal Code and sections 6 and 8 of the P.O.C.S.O. Act.
The victim in her statement under Section 164 Cr.P.C has stated name of other male accused persons who had kidnapped her. The victim has not named this petitioner in her statement under Section 164 Cr.P.C. Petitioner is a female. Learned counsel for the informant opposes the prayer for bail of the petitioner.
Considering the facts that there is no specific material
Patna High Court Cr.Misc. No.63004 of 2018(3) dt.09-01-2019 2/2 against this petitioner, let the petitioner above-named, in the event of her arrest or surrender before the court below within a period of thirty days from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge Ist-cum-Special Judge, Siwan in connection with Basantpur P.S. Case No. 142/2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
