JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-10-2019 This is an application for grant of anticipatory bail in connection with Bihpur P. S. Case No. 165 of 2018, disclosing offence under Section 392 of IPC.

As per F.I.R. the informant was working as Manager in a financial company and was coming with the amount collected during the day, some miscreants on the point of rifle snatched away the money and other articles from him. Submission of the learned counsel for the petitioner is that he has not named in the F.I.R. he has been named in the restatement of the informant. He is a student and has falsely been implicated in this case, having no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides, in view of the allegations, I am not inclined to grant privilege of anticipatory bail to the

Patna High Court CR. MISC. No.45143 of 2019(3) dt.21-10-2019 2/2 petitioner. However, he may surrender and pray for regular bail before the learned court below, the same shall be considered on its own merit, without being prejudiced by order of this Court.
