Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.

The petitioner seeks regular bail in connection with Chakia P.S. Case No. 254 of 2022 lodged under Sections 25(1b)a, 26 of the Arms Act. As per the prosecution case, recovery of one loaded country made pistol has been made from the possession of the petitioner.

Learned counsel for the petitioner submits that antecedent of the petitioner is clean. He is in custody since 21.06.2022. Upon specific query that whether charge has been framed or not, learned counsel for the petitioner submits that he

Learned counsel for the State opposes the prayer for bail and submits that arms has been recovered from the possession of the petitioner.

In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner, therefore, bail application of the petitioner is hereby rejected. But petitioner has a liberty to move for bail after 2 months of framing of charge.

Thereafter, the Trial Court shall release the petitioner on bail imposing its own conditions so that he may not evade his appearance during trial.

With this observation, the bail application stands rejected.
