JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-01-2019 The petitioner seeks bail in anticipation of his arrest in connection with Falka(Pothiya) P.S. Case No. 229 of 2018 dated 15.06.2018 instituted for the offences under Sections 379, 356 of the Indian Penal Code.

After some argument, Mr. Bhola Prasad, learned counsel for the petitioner seeks permission to withdraw the present petition in order to enable the petitioner to surrender before the Court below and seek regular bail. In case such a petition is filed, the Court below shall take into account that one of the similarly situated coaccused persons has been granted bail by the Court below and but for the CCTV footage which shows the presence of the petitioner near the bank, there is no other material

Patna High Court Cr.Misc. No.61823 of 2018(4) dt.25-01-2019 2/2 against him and shall pass orders in accordance with law without being prejudiced by the fact that the present petition for anticipatory bail has not been entertained. The petition is dismissed as withdrawn with the aforesaid observation.
