2. The present application has been filed seeking cancellation of the bail granted to Opposite Party No. 2, who was enlarged on bail by the learned S.D.J.M., Sherghati, vide order dated 28.11.2022 passed in Complaint Case No. 494 of 2018.
3. It appears from the record that the petitioner had earlier challenged the aforesaid order granting bail by filing an application for cancellation of bail before the learned Principal District & Sessions Judge, Gaya and the same was dismissed because of non-prosecution.

4. Accordingly, the present application is disposed of with liberty to the petitioner to file a fresh application seeking cancellation of the bail granted to Opposite Party No. 2 before the learned Principal District & Sessions Judge, Gaya.
5. If such an application is filed, the learned Principal District & Sessions Judge, Gaya shall consider and dispose of the same on its own merits, in accordance with law, preferably within a period of three months from the date of its filing.
6. It is made clear that this Court has not expressed any opinion on the merits of the rival claims and all questions are left open to be considered by the learned Principal District & Sessions Judge, Gaya.
