This application for anticipatory bail arises out of Baghaila P.S.Case N0. 58 of 2016, disclosing offences under Sections 364,341,323,504/34 of the Indian Penal Code. Petitioner No.1 is the daughter-in-law of the informant. Other petitioners are father, brother and maternal uncle of petitioner No.1. It is alleged that the informant's son, who is husband of petitioner no.1 has been kidnapped by the accused persons.
Learned counsel for the petitioners has submitted that petitioner No.1 was being put to harassment by the accused persons and just to create pressure on petitioner no.1, the present
Patna High Court Cr.Misc. No.42906 of 2017(2) dt.20-09-2017 2/2 case has been filed. I am, prima facie, satisfied with the submission advanced on behalf of the petitioners. Considering the above submission, this application is allowed.
Let the petitioners above named in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate3, Sasaram at Rohtas in Baghaila P.S. Case No. 58 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
