JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner and the State. The petitioner is in custody since 01.07.2014 in a case registered for offences punishable under Sections 364/120 (B)/34 and subsequently added 302, 201 of the Indian Penal Code. It is the petitioner's plea that he was not named in the F.I.R. and merely on the basis of suspicion, he was apprehended. He further submits that no other material has been collected in course of investigation, apart from the petitioner's confessional statement to connect him with the alleged offence. Learned counsel for the petitioner further submits that in similar circumstance, other co-accused Jhonny Kumar Basfor @ Jani Kumar Basfor, who was merely seen at the place from where the
Patna High Court Cr.Misc. No.50658 of 2014 (3) dt.03-03-2015 2/2 dead body of the deceased has been recovered, has been granted bail vide order dated 12th November, 2014 passed in cr. Misc. No. 40782/2014.
Considering the facts and circumstances, the above named petitioner, Ashish Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Munger in connection with Kasim Bazar P. S. Case No. 95/2014.
