JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 4.9.2014 in a case registered for the offences punishable under Sections 448,376,504 and 506 of the Indian Penal Code though subsequently charge sheet was submitted under sections 448,420,376,504 and 506 IPC and section 4 of Protection of Children from sexual Offences Act, 2012.
The accusation is of establishing physical relationship with the informant on promise of marriage.
It is submitted by the learned counsel for the petitioner that the informant victim is major and the petitioner and informant have agreed to marry. The agreement has been brought on records as Annexure 3.
In view of the agreement of the parties, the learned APP
Patna High Court Cr.Misc. No.51709 of 2014 (2) dt.06-01-2015 2/2 is not opposing the prayer of the petitioner for bail. Considering the stand of the informant, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Naugachia in connection with Naugachia Mahila P.S. Case No. 43 of 2014.
The petitioner's bail bond will be accepted by the learned court below on appearance of the informant on notice and her admitting about the agreement as contained in Annexure 3. (Dinesh Kumar Singh, J) Anil/- U T
