The petitioners apprehend their arrest in connection with Barachatti P.S. Case no. 431 of 2016, registered under Sections 420, 467, 468, 471, 414 and 120-B of the Indian Penal Code. The accusation is of carrying of coal loading on Trucks bearing Reg. Nos. JH-09R-8539 and JH-02Z-3717 by preparing the forged documents, showing the fake name of driver and owner of the said trucks, which were detected on comparing the papers relating to the loading of the coal and the paper of ownership of the trucks. Learned counsel for the petitioners submits that both the petitioners are owner of the aforesaid trucks and coal was loaded on both trucks from M/s. Maa Jagdamba Coal Trading, which was being
Patna High Court Cr.Misc. No.16537 of 2017 (3) dt.09-08-2017 2/2 carried to Balia (U.P), but with ulterior motive, the petitioners, who are the owner of the said trucks, have falsely been implicated in this case. Further submission is that petitioners have no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M. Sherghati, Gaya in connection with Barachatti P.S. Case No. 431 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
