The petitioner is apprehending his arrest in a case registered under Sections 341, 323, 354(b), 504/34 of the Indian Penal Code and Sections 8/12 of the POCSO Act. Allegation against the petitioner is of misbehaving with the daughter of the informant.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. After investigation the police had submitted final form against the petitioner. The case has been found to be false in course of

Patna High Court Cr.Misc. No.68570 of 2018(3) dt.22-01-2019 2/2 investigation. The final form submitted by the police is Annexure-3 to the present application.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge 1st, Jamui in connection with Khaira P.S. case No.108 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
